1. Acceptance of Terms

By accessing or using EAP Generator ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

EAP Generator provides a software tool that generates Emergency Action Plan documents based on information provided by the user. The Service is intended to assist businesses in creating a starting point for OSHA 29 CFR 1910.38 compliance documentation.

3. User Responsibilities

You are solely responsible for:

  • The accuracy of all information you provide to generate your plan
  • Reviewing your generated Emergency Action Plan before implementation
  • Ensuring your plan meets all applicable federal, state, and local regulations
  • Training your employees on the plan
  • Keeping your plan current and updated as conditions change

4. Not Legal or Safety Advice

The documents generated by EAP Generator are not legal advice and do not constitute a guarantee of regulatory compliance. EAP Generator is a software tool, not a licensed safety consultant or attorney. We strongly recommend having your plan reviewed by a qualified safety professional before implementation.

5. Payment and Refunds

Payment is required to generate and download your Emergency Action Plan. We offer refunds within 7 days of purchase if you are not satisfied with your generated plan. To request a refund, contact us at support@eapgenerator.com within 7 days of your purchase date with your order number. Refund requests submitted after 7 days will not be accepted. If you experience a technical issue that prevents delivery of your plan, contact us immediately and we will resolve it or issue a full refund.

6. Regenerations

Each purchase includes a set number of plan regenerations as stated at the time of purchase. Regenerations allow you to update your answers and produce a revised document. Unused regenerations have no cash value and are non-transferable.

7. Intellectual Property

The generated Emergency Action Plan document is provided for your business use. EAP Generator retains ownership of the underlying software, templates, and generation system. You may not resell or redistribute generated plans as your own product or service.

8. Limitation of Liability

To the fullest extent permitted by law, EAP Generator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any generated document. Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the Service.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that generated plans will be free from errors, that they will satisfy all regulatory requirements, or that they will be suitable for your specific situation.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
